I know you're not in my state, but I am writing for advice. Not even sure you will see this comment in time to help, but I'm "scared" so I want to try. I have endless questions. I'm being sued on an approximately year old debt (Synchrony Bank) of $1334. PRA are the ones suing. My court date is in two days from now. (November 16, 2018). I am in Gatesville, Texas. To many, this may not seem like a big deal or a big debt, but this has ruined my credit and I am unable to do anything because of it. I cannot afford to wait 7 years for it to potentially "go away". I am on disability for $635 a month. Will any of these points, brought up in the court room, help me?
1- I plan to deny. Is it a valid argument (in court) to say that, although I deny the debt, I have no contract with PRA even if I had supposedly owed the debt to Synchrony Bank? proof that PRA even owns the debt?
2- Bringing up that the original creditor, Synchrony Bank, charged it off?
3- Bringing up that PRA bought the debt for pennies on the dollar, therefore they are suing for more than what they paid for the debt? I can't even realistically afford 50% of the debt. I obviously can't afford an attorney to help.
4- Do they even have the jurisdiction to sue me? The attorney they are using is out of Dallas, Texas area. PRA itself is headquartered in Norfolk, Virginia. Do any of these points hold any weight and better my chances if said in court?
