Can you be sued by a debt collector? Unfortunately, the answer is ???? yes.

Some debt collectors can get quite aggressive…AND there are few things worse than being sued by anyone—especially being sued by a debt collector! I know you don’t need that negativity in your life! If you’ve been served with a debt collection lawsuit, you’ll want to know exactly how to respond to a debt collector lawsuit.

Surprisingly, just responding to the lawsuit dramatically increases your chances of not having to pay the debt—I mean ZERO! That’s because debt collectors are great at initiating lawsuits, but they suck at actually winning. They rarely have the evidence or resources to follow through with a successful case.

In fact, most debt collectors file lawsuits expecting you to just not show in court — because that’s often what happens. When a consumer fails to respond to a lawsuit, they automatically lose the case, and the debt collector wins by default. Don’t let this happen to you!

Push back against a debt collector’s lawsuit.

Here's a situation: A tenants' apartment was destroyed by a burst pipe so he moved into a hotel at his own expense & later moved what remained of his belongings, out of that apartment. Then the owner kept the rent for the time the tenant was in the hotel and kept his security deposit. The owner then claimed the tenant owed money even though he does not (always paid the rent on time or early & kept the apartment in superior condition). To add insult to injury, the owner placed something on the former tenants' credit report, citing money was due. What can that former tenant do?

I’m not sure it’s a contract with the bank, because there was no meeting of the minds! An application isn’t necessarily a contract

I don’t remember the debt it happened during the pandemic. I moved from an address. I don’t have a problem paying $1000 but I can’t miss work to go to court. What do I do?

@rubentorious says:

They did not have a contract. I still lost.you are wrong

Why would you wait til you’re sued to request verification? Request it as son as they start trying to collect from you!

Not knowing the mental state of someone on a sidewalk engaged in lawful activity does not give them the right to detain. Chris does seem to know what the caller said..

I won a case by sending a letter. Debt collector went to court at their own expense to have the prior judgement dismissed! It worked !

@BoldlyMovingForward says:

What if the debt collector is the original creditor. The debt is a charge off but still the original creditor.

I live in TX and just went to court and for my defense. I told the judge. I don't have contract with debt collector and they don't have my wet signature and Judge said it doesn't matter if they have it or not and Judge said i need to pay.

CAN THEY GARNISH WAGES IF I HAVE GOTTEN THE NEGATIVE CLOSED ACCOUNT REMOVED OFF MY CREDIT REPORT?

@lis4846 says:

I have a debt collector reaching out and they couldn't provide the items I staked for to validate the debt. However, I noticed a court case was filed and its under the CC company's name. Does this mean that the CC company simply hired the debt collector to try and collect? It doesn't make sense to me why they would do that?

@suzanneladue5828 says:

Thank you for the video! I appreciate it. Unfortunately, in Manitowoc Wisconsin this is not what happens. The case is only dismissed if they like you. I had LVNV not show up for court and the court commissioner did not even dismiss it. The joke is on them because I’m putting in for a discovery for a chain of title ownership for the debt.????
