Check your terms and conditions for your credit card! Most have an arbitration agreement and they usually survive any buyers of the alleged debt. The debt collector will take on the agreement and they definitely know it exists. They are just banking on you not knowing about the agreement and not responding to the lawsuit. The federal arbitration act mandates that these agreements be honored.

What is you are being sued by the original creditor in smalls claims court and there is an arbitration agreement but it has an exception for small claims. Can you still compel arbitration?
