I was recently served a lawsuit from PRA, but on the complaint they did not include a single affidavit, credit card statement or any other evidence. Do they usually include supporting documentation when suing? Could this possibly mean that they don't have enough evidence and that maybe they were just testing their luck with the lawsuit?

Here in the uk i said to the debt buyer that if you can proove it then i will pay no problem, they ignore that take it to court il say to the courts i offered to pay once i have proof they cant supply proof so the faults with them not me

Hi. I got sued by portfolio recovery associated for $4500 and they won because I did not show up to hearing. After couple of months judge dismissed garneshee ( me and my employer ). Looks like same collection agency filed a new lawsuit two months later. Can they attempt to garnish from employer again or is employer safe ? What should I do this time ?

I called July 31st & we agreed on a settlement . They said they would mail the docs that I need to sign & said I would receive it in two days because we are in the same area. I called them almost every other day Looking for the letter. I finally received it August 16th. The offer says if I don’t pay by the 15th I’m in default and they will go after the full amount. I’m afraid now if I pay they will still go after the full amount even though they didn’t hold up their end by getting me the docs until AFTER the due date. Here it is the 19th and we have court in two days. Do I pay it and show up to make sure it’s dismissed, or do I hold off paying it and state my case to the judge?

PRA has just served me a summons to my local district court for a supposed debt from an old charge off credit card. They attached an affidavit from a PRA employee stating knowledge of the records kept that verifies debt. How do I object to the affidavit when sending my answer and affirmative objections to the courthouse or do I have to wait until my day in court. The business records exception states “first hand knowledge” and complete record keeping that surely PRA could not have since they are not the original account grantor. Please help!

My experience with an Id. District magistrate court was a true reflection as to just how criminal the courts are. I was sued by an attorney and I can't say who, for a Capital One case several years ago. I barely knew enough to keep him off the sand because attorneys try to act like their witness, they cannot be so. What they also try to do is in their role as attorney is disguise the fact that they're the actual debt collector which in Idaho is it crime. Yes of course I took this to the Attorney General's office and despite even a Supreme Court case upholding that attorneys cannot be debt collectors they chose to look the other way. On the first go-round the judge gave a decision to the attorney on a bad affidavit after all my objections were over ruled, often not even ruled upon. I appealed it and the case was sent back to the Magistrate because frankly he's an idiot. And I'll be darned if after the first hearing that magistrate didn't make what is called a "Sua sponte", decision. I could have appealed that only after I paid the deposited the entire amount of the Judgment that was handing over to this criminal debt collector attorney, who actually used to be a city prosecutor can you believe that crap. That fancy word above means despite the evidence a magistrate did find for the plaintiff despite evidence or lack thereof.
Long story short, that attorney may claim that I was unjustly enriched down the road. No revealing identification information was intentionally provided here.

They're still calling me, even though the debt they're calling about was PAID OFF BACK IN 2011. It's also been removed from my credit report (all 3 bureaus) and the statute of limitations for the period it can even show up on my credit report expired way back in 2015. These people are scum. Harassing people for money they no longer owe.

I sent Portfolio Recovery a letter to validate the debt they sent me a credit card statement from the old credit card account I had and the bank don't exist no more. Is that proof them sending me the credit card statement does not have my signature on it

I am desperate for advice, I had a hearing today and Portfolio Recovery associates enlisted a local lawyer to do the case. I was not served properly (Not served at all) and wrote letter to judge when I found out they were trying to get a judgement against me for not answering the service, I also wrote their attorney in Virginia with a request for production. I had my case all planned out, but spoke with their locally enlisted attorney and he showed me but didn't give me a copy he had of a letter he stated was the reply to my request for production, and that he would contact them and have them resend it but that I should request a copy of the production myself. He was very nice, but he was fishing for information because I am sure he was looking for any information that he could get from me. He stated that the credit card company said everything was done electronically via phone call and that is how they have the right to sue. He also claimed that they had the entire history of payments. I was not expecting any of this, should I be worried? What should my next move be? Please help me!! You are the only one I trust on here…
